1. Acceptance of Terms
These Terms of Use govern your access to and use of the Winnipeg Investigator website and all investigation services provided by Winnipeg Investigator (referred to as “we,” “us,” or “our”).
By using our website or engaging our services, you confirm that you are at least 18 years of age, that you have the legal capacity to enter into a binding agreement, and that you have read, understood, and agree to these terms.
2. Description of Services
Winnipeg Investigator provides licensed private investigation services in Winnipeg and Manitoba, including but not limited to: surveillance, infidelity investigations, child custody investigations, background checks, address searches, missing persons investigations, electronic bug detection (TSCM), and insurance fraud investigations.
All services are conducted by or under the supervision of licensed private investigators holding valid provincial licences issued under Manitoba legislation. The scope, terms, and deliverables of any specific investigation are agreed upon between the client and Winnipeg Investigator prior to commencement of work.
3. Lawful Use Only
Our services may only be engaged for lawful purposes. By retaining us, you confirm that:
- The purpose for which you are retaining our services is legal under Canadian law and Manitoba law
- You will not use investigation findings to harass, stalk, intimidate, or harm any individual
- You will not use our services in connection with any illegal activity
- Any information you provide to us about third parties is provided in good faith and to your knowledge is accurate
We reserve the right to refuse or terminate any engagement where we believe the purpose is unlawful, unethical, or likely to result in harm to any individual. If we terminate an engagement on these grounds, any fees paid for work already completed will not be refunded.
4. Client Obligations
As a client, you agree to:
- Provide accurate and complete information to the best of your knowledge to assist in the investigation
- Inform us promptly of any changes in circumstances that may affect the investigation
- Use investigation findings and evidence in a lawful manner
- Not share, publish, or distribute investigation reports or evidence in a manner that violates Canadian privacy law or defames any individual
- Make timely payment of agreed fees as per the terms established at engagement
Winnipeg Investigator will not be responsible for outcomes resulting from inaccurate or incomplete information provided by the client.
5. Fees and Payment
Fees for investigation services are agreed upon between the client and Winnipeg Investigator prior to the commencement of any work. A written engagement agreement or quote will be provided outlining the scope of work and applicable fees.
Payment terms, deposit requirements, and billing arrangements are specified in the individual client engagement agreement. Fees may vary based on the complexity, duration, and geographic scope of an investigation.
All fees are quoted in Canadian dollars. Applicable taxes will be applied where required by law.
6. Confidentiality
Winnipeg Investigator treats all client information and case details as strictly confidential. We do not discuss, share, or disclose client information to third parties except as described in our Privacy Policy or as required by law.
Clients are also expected to treat information provided to them by Winnipeg Investigator — including investigation reports, findings, and evidence — with appropriate discretion and in accordance with applicable law.
7. Use of Investigation Evidence
Evidence gathered by Winnipeg Investigator is provided to the client for lawful use only. The client is responsible for ensuring that any evidence is used in compliance with Canadian law, including privacy legislation and defamation law.
Winnipeg Investigator makes no guarantee that evidence gathered will be admissible in any specific legal proceeding. Admissibility is determined by the court or adjudicator based on applicable legal standards. Clients should seek independent legal advice regarding the use of evidence in legal proceedings.
Copyright in all reports, photographs, and video footage produced by Winnipeg Investigator remains with Winnipeg Investigator unless otherwise agreed in writing. The client is granted a licence to use such materials for the purpose for which they were produced.
8. Disclaimer of Warranties
While we endeavour to conduct all investigations with professional care and skill, Winnipeg Investigator does not guarantee any specific outcome, finding, or result from an investigation. Investigations are inherently subject to variables outside our control, including subject behaviour, access limitations, and environmental factors.
Our website is provided on an “as is” basis. We make no warranties, express or implied, regarding the accuracy, completeness, or fitness for purpose of any content on this website.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Winnipeg Investigator’s total liability to any client for any claim arising from our services shall not exceed the total fees paid by that client for the specific investigation giving rise to the claim.
Winnipeg Investigator shall not be liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use our services, or from the use or non-use of information provided in investigation reports.
10. Website Use
You may use this website for lawful purposes only. You agree not to:
- Use the website in any way that violates applicable local, national, or international law or regulation
- Attempt to gain unauthorised access to any part of the website or its underlying systems
- Transmit any unsolicited commercial communications
- Use automated tools to scrape, crawl, or collect data from this website without our permission
We reserve the right to restrict access to this website at our discretion.
